Plain-language terms for using MTBCoach.
⚠️ Mountain Biking Safety Disclaimer
Mountain biking is an inherently dangerous sport. MTBCoach is a coaching aid, NOT a replacement for proper training, protective gear (helmet at minimum, ideally also pads and protectors), trail knowledge, or judgment. You ride entirely at your own risk. Always ride within your skill level. Never look at the screen while moving — use audio coaching for hands-free feedback.
🩺 Medical Disclaimer
MTBCoach's crash detection and emergency contact feature is an aid, NOT a guaranteed emergency response system. It may fail to detect a crash, or trigger when no real emergency exists. Always carry a phone with sufficient signal, ride with a partner when possible, and inform someone of your planned route.
1. Service Provider
MTBCoach is operated by Dipl.-Ing. Mihajlo Grmaš (Einzelunternehmen, Gmeinstraße 12b/12, 8055 Graz, Austria; GISA 39063410). See Impressum for full details.
2. License & Use
By installing MTBCoach, you receive a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes. You may not reverse-engineer, redistribute, or attempt to extract the app's source code.
3. Pricing
MTBCoach offers four tiers — all one-time purchases, no subscriptions:
All purchases are processed through Apple App Store (and Google Play when available). Pricing may vary slightly by region due to local taxes and currency conversion.
4. Refunds & Withdrawal Right
As digital content delivered immediately upon purchase, you waive your 14-day right of withdrawal (§ 18 Abs. 1 Z 11 FAGG) by completing the purchase. However:
- Refunds are handled by Apple/Google per their respective store policies
- For Apple: support.apple.com/HT204084
- If MTBCoach malfunctions and we cannot fix the issue within 14 days, we will help facilitate a refund
5. App Updates & Lifetime Definitions
"Lifetime" means the supported lifespan of the MTBCoach app — at minimum 5 years from your purchase date, longer if the app continues to be maintained. If we sunset the app, ELITE/PRO users will receive 90 days advance notice and a final data export tool.
6. Acceptable Use
You agree NOT to:
- Use the app while operating a motor vehicle
- Use the app in a way that endangers others on the trail
- Share account credentials or family-share PRO/ELITE outside Apple's Family Sharing rules
- Attempt to bypass paywalls, tier restrictions, or DRM
7. Disclaimer of Liability
To the maximum extent permitted by Austrian law: MTBCoach is provided "as is," without warranty. We are not liable for:
- Personal injury resulting from your riding decisions
- Inaccurate Flow Score, GPS data, or sensor readings
- Crash detection failures or false positives
- Loss of data due to phone failure (always back up before factory reset)
- Third-party service outages (Apple, Google, Strava, Plausible)
This does not exclude liability for grossly negligent or intentional acts where Austrian consumer protection law applies.
8. Governing Law & Jurisdiction
These terms are governed by Austrian law. Disputes shall be resolved by the competent court at the seat of the service provider (Graz, Austria), unless mandatory consumer-protection rules of your country of residence apply.
9. Changes to Terms
We may update these Terms. Material changes will be announced in-app at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
